Unsafe Children's & Baby Products

Houston, Texas, Dangerous Baby Product Lawyers

Manufacturers and distributors of children's products and baby toys have a legal responsibility for designing and making their products safe for the child. Children cannot be expected to read instructions or pay attention to warning labels, so manufactures have an obligation to consider every possible safety concern that a child or baby might encounter. Even after many decades of baby product lawsuits making the news, thousands of young people continue to sustain serious injuries while using defective toys, clothing, dangerous medications, car seats, and other products. Unfortunately many of the victims are infants, babies, and toddlers.

Courts and juries take children's product safety seriously

In many cases, injuries to children can be avoided if the manufacturer or distributor would take additional steps to avoid design defects. In an age of computer-aided design and space-age materials, there is little justification for not knowing when a product will fail when used by a child or baby. A defective product is largely the result of such lack of attention to necessary or intended manufacturing processes.

Important factors to evaluate in baby product cases include whether there are adequate warnings and whether the product's flaws are manufacturing or design defects. A manufacturing defect occurs when the finished product does not conform to the manufacturer's plans or specifications, such as when a new car malfunctions and causes an accident. A design-defect occurs when a manufactured product is unreasonably dangerous, as in a child's car seat that provides little or no protection in a side-impact collision.
